END-USER LICENSE AGREEMENT
This user agreement constitutes a legal agreement between the User and TREOMIND. By accepting this agreement, you declare that you agree to all the terms and conditions set forth herein, and the agreement becomes legally binding for both parties upon acceptance.

ARTICLE I – LICENSE GRANT
Subject to the terms of this agreement, TREOMIND grants the user a non-exclusive license to download and install the software. Additionally, TREOMIND grants the user a non-exclusive license to use TREOMIND materials. The user is obliged to use the software solely for personal use, not on behalf of any third party. The user may not modify the software, reverse engineer, disassemble, or attempt to access the source code in whole or in part—such actions are strictly prohibited.

Ownership and Reservation of Rights
By entering into this agreement, the parties acknowledge and confirm that all intellectual and industrial property rights and related financial interests referred to herein are the sole and exclusive property of TREOMIND.

Legal Use and Enforcement
The user is solely responsible for execution and data on TREOMIND. By this agreement, the user agrees to indemnify TREOMIND against any loss, cost, or expense arising from a breach of the agreement, and to use the license in a way that does not cause damage, ensuring compliance with all terms.

The user agrees to comply with all prohibitions, rules, and regulations and not to infringe upon the rights of third parties. This product is provided by TREOMIND for use only by the end-user. The user may not sell, distribute, or lease the product, nor use it on behalf of third parties under any circumstances.

Data Collection and Privacy
The user consents to TREOMIND collecting a limited amount of non-personally identifiable data, such as backup frequency and completion time, from the user’s computer.

By accepting this agreement, the user also consents to data collection as outlined in TREOMIND’s Privacy Policy published on its website.

TREOMIND reserves the right to modify the content of this agreement without notice.

ARTICLE II – REPRESENTATIONS, WARRANTIES, AND LIMITATIONS OF LIABILITY

General Warranty
The parties are obliged to comply with all provisions and fulfill all obligations set forth in this agreement. This agreement does not cover or bind any agreements made by the parties with third parties.

Disclaimer of Other Warranties
TREOMIND disclaims all warranties, whether oral/written, express or implied, other than those explicitly stated in the “General Warranty” section. The user is solely responsible for any consequences, damages, or assessments arising from using a similar or parallel third-party service.

Limitation of Liability
Under no circumstances shall TREOMIND, its suppliers, partners, or agents be liable for indirect, incidental, consequential, special, exemplary, or punitive damages or any matters not explicitly covered by this agreement.

Without limiting the above, the total liability of TREOMIND, its suppliers, partners, or agents shall not exceed the actual amount paid under the agreement. If no payment has been made, TREOMIND has no liability.

These limitations include, but are not limited to, misuse, inability to use the software, service interruptions, suspensions, or termination of the software or service (including damages caused by third parties). These limitations shall apply to the maximum extent permitted by law, even in the case of fundamental failure.

Some states or jurisdictions do not allow limitations or exclusions of incidental or consequential damages. In such cases, the above limitations may not apply.

ARTICLE III – MISCELLANEOUS

Termination and Continuation
If either party fails to comply with any provision of this agreement, the other party has the right to terminate it. All provisions (excluding force majeure) shall remain effective until the expiration date of the agreement. Upon termination, the user may no longer use any provided credentials or codes.

Governing Law
This agreement is governed by the laws of the Republic of Türkiye.

Assignments
Any direct or indirect assignment of this agreement by the user without written permission from TREOMIND is invalid.

Trademarks, Services, and Intellectual Property
All trademarks, service marks, and other assets on TREOMIND belong to their rightful owners. TREOMIND’s copyrights and intellectual property rights are protected under the law. The user agrees not to harm or interfere with TREOMIND’s or its licensors’ rights.

Waiver
Failure by either party to exercise any provision or right under this agreement does not constitute a waiver of such provisions or rights.

Entire Agreement
This agreement constitutes the entire understanding between the parties concerning the subject matter herein and supersedes any prior agreements.

Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Export Restrictions
By signing this agreement, the user acknowledges that TREOMIND is subject to the laws and restrictions of the Republic of Türkiye. The user agrees not to export this product directly or indirectly to restricted countries or for restricted purposes.

Third-Party Acknowledgements
TREOMIND may use third-party software and copyrighted materials. Related approvals, licenses, and disclaimers are subject to the corresponding agreements.
